Terms of Service

1. Acceptance of Terms

By accessing or using the MyCoach platform ("Service"), including chatbot.mycoach.ing, cp.mycoach.ing, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

2. Description of Service

MyCoach provides an AI-powered chatbot platform with two bot modes:

• Customer Support & Sales Bot: Pre-trained on 5,000+ real conversations for support, sales, and lead generation
• AI Tutor & Course Assistant: Pre-trained on 2,800+ educational dialogues using Socratic teaching methods (Pro and above)

Additional features include:

• 26+ ready-made widget designs and templates
• Training from text, URLs, PDFs, documents, and YouTube channels
• Multi-AI model support (OpenAI, Anthropic Claude, Google Gemini, xAI Grok)
• Website widget embedding with domain/IP restrictions
• Lead capture, CSV export, and webhook integrations
• Client workspaces and team collaboration
• WordPress auto-publish (Agency and above)
• White-label and custom branding options

3. Accounts & Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to use the Service.

4. MyCoach Credits

4.1 Credit System

The Service uses a unified credit system called "MyCoach Credits." All actions consume credits:

• 1 chatbot reply = 1 credit
• 1 website crawl page = 1 credit
• 1 YouTube transcript minute = 1 credit
• 1 AI blog article = 25 credits

4.2 Monthly Credits

Each subscription plan includes a monthly credit allowance that resets on the 1st of each month. Unused monthly credits do not roll over.

4.3 Purchased Credits

You may purchase additional credits at any time. Purchased credits never expire and are used only after your monthly allowance is exhausted. Purchased credits are non-refundable.

5. Subscription Plans & Billing

• Free plan: Includes 100 credits/month, 1 bot, 3 documents, 3 templates, 3 widget designs. No credit card required.
• Starter ($19/mo): 1,000 credits/month, 2 bots, 10 documents, 10 templates, GPT-4o access.
• Pro ($49/mo): 5,000 credits/month, 5 bots, 50 documents, 26+ templates, all AI models, Sales + Tutor bot modes, webhooks.
• Agency ($149/mo): 20,000 credits/month, 25 bots, 200 documents, BYOK included, white-label, 20 workspaces, auto-publish.
• Enterprise (Custom): 100,000+ credits/month, unlimited bots, custom integrations. Contact us for pricing.

Additional terms:

• Paid plans are billed monthly via PayPal.
• Plan upgrades take effect immediately upon payment.
• Downgrades can be requested by contacting support and take effect at the next billing cycle.
• No refunds are provided for partial months or unused credits.
• We reserve the right to change pricing with 30 days' notice.

6. Add-ons

The following add-ons may be purchased to extend your plan:

• Extra Credits: 1,000 credits for $10 or 5,000 credits for $39 (never expire)
• Extra PDFs: 10 additional PDF uploads for $5
• Extra Workspace: 1 additional client workspace for $10
• Bring Your Own API Key: $9/month add-on for Pro plan (included in Agency and Enterprise)

Add-on purchases are non-refundable. Credit add-ons never expire. Other add-ons remain active while your subscription is active.

7. Acceptable Use

You agree NOT to use the Service to:

• Generate or distribute harmful, illegal, or misleading content
• Impersonate any person or entity
• Violate any applicable law or regulation
• Distribute spam or unsolicited communications
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service for medical, legal, or financial advice without proper disclaimers
• Upload content that infringes on intellectual property rights
• Reverse-engineer, decompile, or disassemble any part of the Service
• Manipulate or artificially inflate credit usage
• Share account credentials or resell access outside of authorized workspace features

8. Content & Data Ownership

• Your content: You retain ownership of all content you upload, including training data, PDFs, and URLs. You grant us a limited license to process this content for providing the Service.
• Generated content: AI-generated responses and articles are owned by you.
• Conversation data: Visitor conversations are stored according to your plan's retention policy and are accessible only to you (and your team members, if applicable).
• Templates: Pre-made templates and pre-trained knowledge bases are our intellectual property. You may use them within the Service but may not extract or redistribute them.
• Our content: The platform, widget code, widget designs, and documentation remain our intellectual property.

9. Data Retention

Chat conversation data is retained according to your subscription plan:

• Free: 7 days
• Starter: 30 days
• Pro: 90 days
• Agency: 1 year
• Enterprise: Unlimited

Training documents, PDF files, and credit balances are retained for as long as your account is active. Upon account deletion, all data is permanently removed within 30 days. Purchased credits cannot be recovered after account deletion.

10. Third-Party AI Services

The Service uses third-party AI providers (OpenAI, Anthropic, Google, xAI) to process queries. Your data may be sent to these providers for processing. By using the Service, you acknowledge and agree to the terms of these providers. If you use the Bring Your Own API Key feature, you are directly contracting with the AI provider and are responsible for compliance with their terms.

11. White-Label & Client Workspaces

Agency and Enterprise plans include white-label options. When using white-label features:

• You may remove MyCoach branding from the widget
• You are responsible for your own terms of service and privacy policy for your end users
• You may not misrepresent the Service as your own proprietary technology
• Client workspaces are isolated — each client's data is separate and not accessible by other clients

12. Availability & SLA

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party providers, force majeure, or circumstances beyond our control.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, credits, or business opportunities.

14. Termination

We may suspend or terminate your account for violation of these Terms. You may cancel your account at any time by contacting support. Upon termination:

• Your access to the Service will cease immediately
• Remaining monthly credits and purchased credits are forfeited
• Your data will be deleted according to our retention policy (within 30 days)
• No refunds are provided for unused subscription time or credits

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be communicated via email or in-app notification with at least 15 days' notice.
